MiCA Stablecoin Oversight Strengthens with Recent ESMA and EBA Measures
Key points
ESMA and EBA actions in mid-October 2026 provide the latest data on MiCA Titles III and IV compliance, sanctions, and supervision of significant stablecoins.
Regulatory bodies in the European Economic Area released fresh data and opinions on MiCA stablecoin rules in October 2026, marking the first full year of enforcement under Titles III and IV. ESMA published its consolidated sanctions report on 15 October while the EBA classified Circle’s USDC as the first significant e-money token on 14 October. These steps clarify supervisory expectations for issuers and CASPs without any new implementation report from the European Commission itself.
ESMA sanctions report and opinion set enforcement tone
The third consolidated sanctions report from ESMA covered administrative measures taken in 2025 across four EEA countries. Ten cases resulted in actions, with five originating in Liechtenstein, two each in Austria and Germany, and one in the Netherlands. Germany imposed the sole monetary fine of €600,000 on Ethena GmbH for unauthorised issuance of an asset-referenced token linked to USDe. No penalties targeted authorised crypto-asset service providers in the period.
On 8 October ESMA issued an opinion directing national competent authorities to prevent authorised CASPs from offering any services tied to non-compliant ARTs or EMTs. The opinion covers trading, custody, transfers and advisory activities. Existing exposures must reach full remediation by approximately 8 January 2027. Simple risk warnings or disclosures will not satisfy the requirement.
EBA significance classification triggers dual supervision for USDC
The EBA’s 14 October decision placed USDC, issued by Circle Internet Financial Europe SAS, under the significant EMT category. Dual oversight begins 12 November 2026. The EBA assumes responsibility for own-funds requirements, reserve composition, liquidity management and recovery planning, while the French ACPR retains governance and fitness assessments. Significant status raises the reserve deposit threshold to 60 percent in credit institutions and lifts the capital buffer to 3 percent of reserves.

As of mid-October, ESMA registers listed roughly 45 to 50 EMT white papers from 24–25 issuers across 14 EEA countries. Zero ARTs had received authorisation. Euro-pegged compliant stablecoin supply rose 22.6 percent year-to-date to approximately $848 million in one dataset. Global tokens such as USDT continue to operate outside the MiCA perimeter. CASP authorisations reached 372–375 following the end of the grandfathering window on 1 July 2026.
Commission review consultation feeds into 2027 report
The European Commission’s targeted consultation on MiCA, which closed 30 September 2026, collected input from EBA, ESMA, ESCB and AMLA on third-country multi-issuer structures, reserve and liquidity standards, and reporting obligations. The Commission must deliver its Article 140 report by 30 June 2027 and may accompany it with legislative proposals. National authorities are now expected to implement the ESMA opinion on non-compliant stablecoins and to complete further significance assessments for other EMTs.
